Notice of the Passing of Development Charges By-Law 04-2023

Please be advised that Council passed the following resolution on July 16, 2024:

• THAT Report TR 13-2024 regarding Bill 185 Development Charges be received; and
• THAT the phase-in of development charges be discontinued; and
• THAT the amended Development Charges be approved and become effective July 17, 2024

TAKE NOTICE that the Council of the Municipality of Lambton Shores passed Development Charges By-law 04-2023 (the “By-law”) on the 10th day of January 2023 under subsection 2(1) of the Development Charges Act, 1997, S.O. 1997 c.27 (the “Act”), as amended;

AND TAKE NOTICE that any person or organization may appeal the By-law to the Local Planning Appeal Tribunal (LPAT) as stipulated under Section 14 of the Act, in respect of the By-law, by filing with the Clerk of the Municipality of Lambton Shores on or before the 19th day of February 2023, a notice of appeal setting out the objection to the by-law and the reasons supporting the objection. (NOTE: If the final appeal date falls on a Saturday or Sunday, the appeal date will extend to the first Monday at 4:30 p.m., following the last appeal day.)

The development charges in the By-law will apply to all new residential and non-residential development, subject to certain terms, conditions and limited exemptions as identified in the By-law. Development charges are levied against new development to pay for the increased capital costs related to the provision of such municipal services as wastewater, transportation, storm sewer, fire, indoor recreation and outdoor recreation.

The development charges imposed by the By-law, which comes into effect on January 10, 2023, are as follows:

The By-law applies to all lands located within the Municipal boundaries of the Municipality of Lambton Shores. Charges for wastewater are applicable only to the wastewater service area of Grand Bend as noted in the following map:
